Safety at work, occupational illness and accidents and health and safety issues can give rise to personal injury claims in the County and High Courts. As an area of practice it is also closely entwined with employment law, because of the contractual duties imposed upon employers to provide a safe system of work for their employees and through a considerable volume of legislation.
Any worker suffering an injury at work may be able to bring a claim for breach of contract and for breach of statutory duty. We have considerable experience iin advising and acting for employees who are either injured at work or suffer an occupational illness (such as "RSI" type claims or stress at work).
In addition to these claims, if a worker with responsibility for health and safety issues raises a concern about a threat to health and safety in the workplace and is subjected to a detriment as a result, he/she may be able to bring a claim for victimisation or for unfair dismissal.
